SHORT TERM RENTAL AGREEMENT

This Short-Term Rental Agreement (the “Agreement”) is made by and between Philip J. Buckingham (“Homeowner”) and  (“Guest”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1.Property: 

The property is located at: Tropical Breeze 11542 Wightman Lane, Captiva, Florida, 33924, USA.

2.Rental Party: 

The rental party shall consist of Guest and the following persons:

3. Maximum Occupancy: 

The maximum number of guests is limited to 10 persons.

4. Term of the Lease: 

The lease begins at 4:00 p.m. on  (the “Check-in Date”) and ends at 10:00 a.m. on (the “Checkout Date”) Checkout must be prompt at 10:00a.m.

5. Minimum Stay: 

This property requires a 7-night minimum stay. If a rental is taken for less than 7 days, the guest will be charged the 7-night rate unless the Homeowner agrees in advance in writing to a lesser rate.

6. Rental Rules: 

Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.

7. Access

Guest shall allow Homeowner or Homeowner’s Caretaker access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.

8. Rental Rate and Fees: 

The rate includes all utilities, linen, beach towels, and cleaning.

9. Deposit and Payment Dates: 

20% deposit is due now; the balance is due 8 weeks before the occupancy date.

10. Cancellation Policy: 

If Guest wishes to cancel his/her reservation, the prepaid funds will be refunded as follows:

a.100% if cancelled 90 days prior to the Check-in Date

b.Less than 90 days prior to arrival all funds will be retained unless the property is re-booked, then a 100% is refunded.

11. Insurance: 

We encourage all renters to purchase traveler insurance, and can provide details if required.

12. Payment: 

The acceptable payment method for both the Deposit and Rental Rate is wire transfer to Homeowner’s depository account as follows:

13. Use of Amenities: 

Guests will always respect that Wightman Lane is a residential neighborhood, governed by the rules of the Captiva Beach Homeowners’ Association (“HOA”). Tropical Breeze is not an event home, and its owners have consistently declined reservations for weddings, reunions, graduations, etc when asked. Guests hereby agree that they are (a) not part of a larger "event group" simultaneously renting other Captiva homes, (b) that they will comply with Captiva's 50dB noise limit after 10:00 pm, (c) that at all times during their stay, guests will limit use of Tropical Breeze's amenities to the people listed on this reservation, and (d) the owners or their representatives reserve the right to terminate this reservation and refund the prorated portion of unused rent in the event the Lee County Sheriff issues a warning or citation for disturbing the peace, or violation of noise or other county or state ordinances.

The parties agree to the terms of this Short-Term Rental Agreement, as evidenced by the signatures set forth below.

Exhibit A

RENTAL RULES

1.Smoking is NOT allowed.

2.Pets are NOT allowed.

3.Guests are not allowed to organize graduations, proms, gatherings, reunions, weddings, receptions or any other function similar in nature.

4.People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest.

5.The house is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

6.Keep the property and all furnishings in good order

7.Only use appliances for their intended uses.

8.Vehicles are to be parked in designated parking areas only. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

9.Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the unit, beach towels are provided and can be taken to the beach.

10.Water and Septic: The property is on a septic system. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time.

11.Storms: If there is a storm or hurricane, no refunds will be given holiday insurance should be purchased.

12.Please be considerate of our neighbors, please ensure all music on decks or around the pool is considerate to others, please turn off once in the house.
